Advance passenger information (API)
For your safety and security, and to conform to aviation regulations, we are required to transfer passenger data to authorities around the world via the Advance Passenger Information System (APIS).
To ensure there are no delays in your immigration clearance, we recommend you provide accurate information when making your booking or checking in prior to arriving, departing or transiting at an airport.
In the Conditions of Carriage, we use the phrase ‘subject to applicable law’ in a number of instances, including without limitation, in those provisions relating to Overriding Law (Article 1(4)), Schedules and cancellation of flights (Article 10) and Liability for damage (Article 16). In those Articles and in other relevant Articles, where we seek to limit our liability or impose conditions on you, such as your right to a refund and/or compensation if a flight is delayed or cancelled, we do not seek to exclude, restrict, modify rights or remedies you may have under the Australian Consumer Law.
Where these Conditions of Carriage apply to consumers in Australia (and consumers of services to and from Australia) (Australian consumer), they are also subject to the Australian Consumer Law and any other Australian law that may apply to the carriage services that we supply. Nothing in these Conditions of Carriage excludes or restricts the application of such laws. These Conditions of Carriage will be read down to the extent necessary to comply with any law, including the Australian Consumer Law.
Consumer Guarantee and Warranties
If you are an Australian consumer, certain warranties and statutory guarantees will apply to the goods and services that we supply to you.
In relation to services, the consumer guarantees under the Australian Consumer Law include that:
We use an acceptable level of care and skill when carrying out our services;
We supply the services within a reasonable time, if there’s no timeframe that we’ve agreed with you; and
The services we provide are fit for purpose.
If we do not supply services in the manner described above, you may be entitled to a remedy under the Australian Consumer Law. In certain circumstances, you may be also entitled to compensation for reasonably foreseeable losses.
Australian Consumer Law means Schedule 2 to the Competition and Consumer Act 2010 (Cth).
Please note that the above is not a comprehensive outline of the rights that may be available to you under the Australian Consumer Law and we recommend that you refer to the ACCC website or obtain independent legal advice for further information.
