This notice summarises the rules on air carrier liability applied by Qatar Airways, as required by European Community Regulation 889/2002 and the international conventions referred to below. For full details, please refer to our General Conditions of Carriage.

Compensation in the case of death or injuryCompensation in the case of death or injury

There are no financial limits on liability for passenger death or bodily injury. Where the Montreal Convention applies, for damages up to 151,880 SDRs (approximately USD 203,000) the carrier cannot exclude or limit its liability, except where there is contributory negligence by the passenger. 

Advance paymentsAdvance payments

If a passenger is killed or injured, Qatar Airways will make an advance payment to cover immediate economic needs on a basis proportional to the hardship suffered within 15 days from the identification of the person entitled to compensation. In the event of death, this advance payment shall not be less than the local currency equivalent of 16,000 SDRs (approximately USD 21,400).

Passenger delaysPassenger delays

Qatar Airways is liable for damage caused by delay in the carriage of passengers, unless it took all reasonable measures to avoid the damage or it was impossible to take such measures. Where the Montreal Convention applies, this liability is limited to the local currency equivalent of 6,303 SDRs (approximately USD 8,400) per passenger.

Destruction, loss or damage to baggage

Qatar Airways is liable for the destruction, loss or damage of baggage up to the local currency equivalent of 1,519 SDRs (approximately USD 2,030) per passenger, for checked and unchecked baggage together (Montreal Convention).

For checked baggage, Qatar Airways is liable even if not at fault, unless the baggage was defective. For unchecked baggage, Qatar Airways is liable only if it was at fault.

Where the Warsaw Convention applies, liability is limited to 17 SDRs per kilo for checked baggage and 332 SDRs per passenger for unchecked baggage.

Baggage delays

Qatar Airways is liable for damage caused by delay to baggage unless it took all reasonable measures to avoid the damage, or it was impossible to take such measures. Liability for baggage delay is limited to 1,519 SDRs (approximately USD 2,030) per passenger.

A passenger may benefit from a higher limit by making a special declaration at the latest at check-in and by paying a supplementary fee. Alternatively, passengers are encouraged to ensure their baggage is fully insured.

Complaints about baggageComplaints about baggage

If checked baggage is damaged, delayed, lost or destroyed, the passenger must write and complain to the air carrier as soon as possible, within 7 days from the date of receipt in the case of damage, and within 21 days from the date the baggage was placed at the passenger's disposal in the case of delay. In both cases from the date on which the baggage was placed at the passenger's disposal.

Liability of contracting and actual carriersLiability of contracting and actual carriers

If the air carrier actually performing the flight is not the same as the contracting air carrier, the passenger has the right to make a complaint or claim damages against either carrier. The name or code of the contracting carrier is normally shown on the ticket.

Time limit for actionTime limit for action

Any action in court to claim damages must be brought within two years from the date of arrival of the aircraft, or from the date on which the aircraft ought to have arrived.

Important note on this summary:

This notice has been prepared in accordance with the form set out in Regulation 889/2002 but should be read subject to the following:

  • The limit of liability for destruction, loss, damage or delay to baggage is 1,519 SDRs in total per passenger.
  • The statement that the carrier whose name or code appears on the ticket is the contracting carrier does not apply in every case (for example, in some interline and codeshare arrangements).

These Conditions have been prepared in English, Arabic and in other languages.  If there is any conflict or inconsistency between a provision of the English language version of these Conditions and a provision of these Conditions in any other language, then the English language version will prevail to the extent of the conflict or inconsistency.
